Who's Here? — Terms of Service

These Terms of Service ("Terms") govern your use of the Who's Here? Chrome extension ("the Extension"), developed and operated by Extion ("we", "us", or "our"). By installing or using the Extension you agree to these Terms. If you do not agree, do not install or use the Extension.

1. Description of Service

Who's Here? is a Chrome browser extension that creates anonymous, real-time chat rooms tied to the URL of the webpage you are currently visiting. It allows users on the same webpage to communicate with one another anonymously.

2. Eligibility

You must be at least 13 years of age to use the Extension. By using the Extension you represent that you meet this requirement. The Extension is not directed at children under 13 and we do not knowingly collect data from children under 13.

3. Anonymous Use

The Extension assigns you a randomly generated anonymous username when you first use it. You do not need to create an account or provide any personal information to use the free features of the Extension. Super User subscribers are identified only by an irreversible cryptographic hash of a Google OAuth token — your name and email address are never accessed, stored, or processed by us.

4. Acceptable Use

You agree not to use the Extension to:

  • Post content that is illegal, threatening, harassing, abusive, defamatory, obscene, or otherwise objectionable
  • Impersonate any person or entity
  • Spam, flood, or repeatedly post disruptive content
  • Share personal information of other individuals without their consent
  • Engage in any activity that violates applicable local, national, or international law
  • Attempt to reverse engineer, decompile, or tamper with the Extension
  • Use the Extension to harass, stalk, or harm any individual

We reserve the right to ban users who violate these rules from rooms we operate, and to report illegal activity to relevant authorities.

5. User Content

You are solely responsible for any messages or content you post through the Extension. By posting content you represent that you have the right to do so and that it does not violate any third party's rights. We do not claim ownership of your content, but by posting it you grant us a non-exclusive licence to store and display it as necessary to operate the service.

6. Content Moderation

The Extension includes an automatic profanity filter. We do not actively moderate individual chat rooms but reserve the right to remove content and ban users who violate these Terms. Room owners who create private rooms are responsible for moderating conduct within their rooms.

7. Subscriptions and Payments

Who's Here? offers optional paid features including Super User subscriptions (monthly and yearly) and individual cosmetic skins. All payments are processed securely by Stripe. We never see or store your payment card details.

  • Subscriptions automatically renew until cancelled. You may cancel at any time via the Stripe customer portal accessible from the Settings tab in the Extension.
  • Cancellation stops future billing but does not entitle you to a refund for the current billing period.
  • Individual skin purchases are one-time payments and are non-refundable once delivered.
  • We reserve the right to change pricing with reasonable notice.

8. No Affiliation with Visited Websites

The Extension creates chat rooms based on the URL of the page you are visiting. This does not imply any affiliation, endorsement, sponsorship, or partnership between Who's Here?, Extion, and the owner of that website. Room names are used solely as location identifiers.

9. Privacy

Your use of the Extension is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Intellectual Property

The Extension, including its design, code, and branding, is owned by Extion and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

11. Disclaimer of Warranties

The Extension is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Extension will be uninterrupted, error-free, or secure. We do not guarantee the availability, accuracy, or permanence of any chat messages.

12. Limitation of Liability

To the fullest extent permitted by law, Extion shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Extension, even if advised of the possibility of such damages.

13. Indemnification

You agree to indemnify and hold harmless Extion and its officers, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the Extension or your violation of these Terms.

14. Termination

We reserve the right to suspend or terminate your access to the Extension at any time for violation of these Terms. You may stop using the Extension at any time by uninstalling it from your browser.

15. Changes to These Terms

We may update these Terms from time to time. Continued use of the Extension after changes are posted constitutes acceptance of the updated Terms. We will update the "Last updated" date at the top of this page when changes are made.

16. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.
